Legal Notice

These Terms and Conditions shall apply to the purchase of any services or goods by Buyer from Seller. Notwithstanding any contradictory terms and conditions which may appear on Buyer's forms, the shipment or delivery of the goods or services made the subject of this invoice and the mailing or delivery of this invoice shall not constitute any acceptance by the Seller of any prior written or oral offer by the Buyer which contained terms and conditions different from or additional to those set forth below. Seller's acceptance of any such offer is expressly conditioned on the terms and conditions set forth below. Buyer's acceptance of the goods or services which are the subject of this invoice shall constitute confirmation of Buyer's acceptance of the terms and conditions set forth below.

No agent, employee or representative of the Seller has any authority to bind the Seller to any affirmation, representation or warranty concerning the goods sold under this contract, unless such affirmation, representation or warranty is specifically included within this agreement. No modification or alteration of the disclaimer of warranty and limitation of remedies provisions shall be valid or enforceable unless set forth in a separate document issued and executed by the Seller.

The Terms and Conditions constitute the entire agreement between you and Dragonfire Guitars with respect to this Web site. The Terms and Conditions supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written between you and Dragonfire Guitars with respect to this Web site. No modification of the Terms and Conditions shall be effective unless it is authorized by Dragonfire Guitars. If any provision of the Terms and Conditions is found to be contrary to law, then such provision(s) shall be constructed in a manner to closely reflect, as much as possible, the intentions of the parties, with the other provisions remaining in full force and effect. 

All notices from Dragonfire Guitars to You shall be made either by e-mail to the address provided by you, by delivery confirmation service postal mail to the address provided by you, or may be posted on our Web site and will be deemed delivered within thirty (30) days after posting. Notices from You to Dragonfire Guitars shall be made either by e-mail to the address we provide on our Web site, sent via this Web site's Contact Us link, or delivery confirmation service postal mail to our address as follows. Delivery shall be deemed to have been made ten (10) days after the confirmed delivery date.

Consumer Agreement

LIMITATION OF WARRANTIES.  Unless an express written warranty is otherwise furnished by the Seller by a separate document, the Seller makes no warranty, express or implied, with respect to the goods sold or the services rendered by the Seller hereunder.  ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO THOSE OF MERCHANT ABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED AND EXCLUDED FROM THIS AGREEMENT.  IN NO EVENT SHALL SELLER BE LIABLE FOR LOSS OF USE OR FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO CONSEQUENTIAL DAMAGES FOR PERSONAL INJUIRIES OR DELAY.  THIS DISCLAIMER OF CONSEQUENTIAL DAMAGES WILL CONTINUE IN FULL FORCE AND EFFECT EVEN IF THE BUYER'S LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.  In the event any component or part of the goods sold or services rendered hereunder have not been manufactured by the Seller, the Seller's sole obligation shall be limited to making available to Buyer any existing applicable warranty of the manufacturer to such component or part to the extent Seller can do so.

INDEMNIFICATION.  In the event Buyer fails to disclaim any warranty with respect to any articles sold hereunder, Buyer shall indemnify and hold Seller harmless from any and all liability, costs and expenses to which Seller may be subjected as a result of Buyer's failure to so disclaim its express or implied warranties.

The obligation to indemnify shall be used in the broadest sense and shall include but not be limited to court costs and attorneys fees incurred by Seller.

RISK OF LOSS; TITLE.  The goods sold hereunder shall be at the risk of the Buyer upon delivery by the Seller to the carrier F.O.B. shipping point.  Title to the goods sold hereunder shall remain in Seller until payment in full by the Buyer.

DELAYS BEYOND SELLER'S CONTROL.  Seller shall not be responsible for delays in performance caused by delays at manufacturing plants, or in transportation or due to strikes, fires, floods, storms, war, insurrections, riots, any governmental regulation, order, act or instruction, or any other circumstances beyond the Seller's reasonable control.

SERVICE CHARGE: TERMS OF PAYMENT; COLLECTION ACTIONS.  Unless otherwise indicated on the face hereof payment terms are payment due upon receipt of order.  If Seller commences an action to collect amounts due on this account, Buyer will indemnify and hold Seller harmless from all expenses incurred in connection therewith, including attorney's fees.

SURVIVAL OF TERMS.  To the extent any provision hereof is held invalid, then that provision shall be deemed to be deleted, and the remaining provisions hereof shall remain in full force and effect.

LIMITATION OF ACTIONS.  Buyer agrees that any action of any kind by the Buyer against the Seller must be commenced, if at all, within one (1) year after the date of purchase. 

GOVERNING LAW: In the event of litigation both parties agree that the Law of the State of business registration of Dragonfire Guitars (DBA) (Parent Company: TNT Custom Guitars, LLC) shall apply and both parties shall consent to the jurisdiction of said State's courts, or in the event of diversity of citizenship, the applicable United States District Court. Both parties expressly waive a trial by jury.

Shipping & Delivery

The risk of loss and title for all merchandise ordered on this Web site pass to you when the merchandise is delivered to the shipping carrier.

Items are shipped from the USA, generally within three days, not including weekends and holidays. Special orders and custom wiring may take longer, but we will always ship as quickly as possible. Shipping charges are flat rate based on your order total and service selected. These are clearly stated during the checkout process prior to completion of your purchase. Non-refundable Shipping and Handling Fees as posted may apply. Any international order selecting a US shipping option will either be cancelled or a separate invoice request for the applicable shipping fees will be sent prior to order processing.

Please note that our shipping carriers may not have Saturday, Sunday or Holiday shipping services available. We reserve the right to use any shipping provider and service as well as packaging and product labeling we choose. Though examples may be shown in the images associated with each item, we do not specify type of item labeling, packaging or shipping materials/method for any particular order as these may vary at our discretion. We typically combine multiple orders or quantities but reserve the right to split shipments for any reason. Please allow at least one business day for tracking number validation as shipment service variations may delay authentication of tracking numbers. This is especially true over weekends or holidays. The shipping service we typically use provides end-point delivery confirmation at destination. It does not require point-to-point scanning service so that travel progress can be monitored in this manner. It is not unusual for a package to be in transit without regular updates.

Please be aware, we pledge to ship as quickly as possible but have no control over delivery times or additional fees such as Customs, Duties or Taxes specific to your location or country. Almost all international delivery delays are caused by Customs or Postal issues in the destination country. DO NOT COMPLETE your purchase if you are not willing to wait or pay for any additional local fees.

Be sure to inspect your order carefully upon receipt for any shipping damage, fit on your guitar, color, and general appearance. Contact us immediately with any concerns or problems. Any shipping damage or transit issue claims must be submitted within two (2) days of delivery. We pledge to address any problems or concerns you have PRIOR to use, modification, or installation.

Shipping fees are non-refundable. Handling fees are non-refundable.

International

International shipping destinations are assessed shipping charges. These are shown during the checkout process prior to order completion when the appropriate international option (if available) is selected. International orders submitted without payment of these shipping fees will either be cancelled or additional payment will be required prior to order processing. Not all products offered on this website are available for international sale or delivery. International shipping options are limited and not all locations are included in available shipping destinations.

Customs and import duties may be applied to International orders when the shipment reaches its destination. Such charges are the responsibility of the recipient of your order and vary from country to country. Contact your local customs office for details.

Shipping laws are different in each country. It is your responsibility to check with your Customs office to verify whether the country to which you are shipping permits the shipment of your products. Seller is not responsible for any direct, indirect, punitive, or consequential damages that arise from improper international shipping practices.

In the event the sale involves a foreign shipment, the Seller declares the invoice to be true and correct.

Be sure to ask any questions prior to purchase. In case of return, shipping is the Buyer's responsibility.

Return Policy

Not all items are eligible for return. Custom work is non-refundable. Shipping costs are non-refundable. Handling costs are non-refundable. Use or modification of a product invalidates return options.

All items are brand new unless otherwise stated. Please be sure of what you are buying and that the product will work for your instrument or playing needs. If you are unsure, please email us with questions prior to purchase.

Return shipping must include tracking service and will be made at Buyer's expense. Tracking information must be provided to Seller. Buyer must make contact and receive instructions as well as a Return Authorization Number (RAN) prior to return shipment.

Goods must be returned within fifteen (15) days of receipt, at Buyer's expense, in the same condition and with all original packing as when shipped to Buyer and must be accompanied by Seller's Invoice. Some items are ineligible for return as stated in the item description. DO NOT peel off the protective covering from items or remove wrapping from any electronics. DO NOT USE, INSTALL, SOLDER, DAMAGE, MODIFY OR ALTER ITEMS YOU WISH TO RETURN. Depending on the item purchased, any type of use or modification may invalidate your ability to return the item.

Fees or charges may apply and be deducted from the refund amount if items are returned with missing components or in used or damaged condition. Some items are ineligible for return as stated in the item description. Any shipping or handling fees or charges paid by Buyer are non-refundable.

Seller will conduct a full audit and examination of all returned goods. Any use, damage, modification, alteration, missing components, etc. will be documented and a commensurate amount will be deducted from the applicable refund amount. Upon request within 30 days of refund, a report documenting deductions assessed will be provided to the Buyer within five (5) business days. Any applicable refund will be applied to the original payment source.

Be sure to inspect your order carefully upon receipt for any shipping damage, fit on your guitar, color, and general appearance. DO NOT remove any protective film or covering, modify or install the product if it does not meet with your approval for any reason. We pledge to address any problems or concerns you have PRIOR to installation or use.

We are happy to process a return of items eligible for return in accordance with our Return Policy so long as product is not installed, used, or modified in any way and all protective covering is intact. We may offer exchanges or replacement parts on an extremely limited basis at our sole discretion. We may decline to accept additional orders after a return to allow time for investigation and return processing. Most problems experienced are simply due to product incompatibility so please read item descriptions carefully and ASK ANY QUESTIONS PRIOR TO PURCHASE.

Miscellaneous

DESCRIPTIONS: Color descriptions in titles and product descriptions represent COLORS only, not material. We provide our opinions; outcomes will vary based on your set-up, equipment, materials, playing ability, etc. Sources of interference are varied and will cause changes in product performance. There are many components and factors that influence the architecture of your ultimate playing sound. The most predictive factor in performance is YOU!

We reserve the right to wire in any style or method we choose. Sample images showing wiring may not exactly reflect what you will receive as each of our techs has their own personal style and "flavor" for wiring preferences. As custom works, not mass-produced, variability is to be expected. Regardless of style, all wired items are thoroughly tested prior to shipment.
